Court Declares Commercial Lease Terminated, Awards Damages Due to Breach and Eviction by Landlord

In March 2009, after a non-jury trial, the Circuit Court for Carroll County issued a declaratory judgment terminating a commercial lease for a warehouse space in Hampstead, Maryland. Source Interlink Distribution, LLC v. BTR Hampstead, LLC. The facts of the case are thoroughly set forth in the Court’s decision, and interesting legal issues were presented and decided.  The Court found that the landlord had breached the covenant of quiet enjoyment and wrongfully evicted the tenant by allowing an adjacent tenant to use and occupy the tenant’s space for a prolonged period of time.

Frank Gorman, Angela Sheehan, and Neal Dongre worked on the case on behalf of the Plaintiff tenant. The matter is currently on appeal.
